<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, el Ministerio de <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" /><st1:PersonName w:st="on" ProductID="la Producción">la Producción</st1:PersonName> median& Decreto Supremo Nro. 003-2008-PRODUCE de fecha 24 de enero de 2008 y <st1:PersonName w:st="on" ProductID="la Resolución Ministerial">la Resolución Ministerial</st1:PersonName> <B>Nro. </B>348-2008-PRODUCE, de 09 de febrero de <st1:metricconverter w:st="on" ProductID="2008, ha">2008, ha</st1:metricconverter> aprobado un </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Régimen Especial </SPAN></B><FONT face="Times New Roman">de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Pesca para </SPAN></B><st1:PersonName w:st="on" ProductID="la Zona Sur"><FONT face="Times New Roman">la </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Zona Sur</SPAN></B></st1:PersonName><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier"> </SPAN></B><FONT face="Times New Roman">del </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Litoral, </SPAN></B><FONT face="Times New Roman">desde los 16"OO' latitud sur hasta el </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">extremo </SPAN></B><FONT face="Times New Roman">sur del dominio marítimo del </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">país.<o:p></o:p></SPAN></B></FONT></FONT></P>

<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, las consecuencias de autorizar la </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">pesca </SPAN></B><FONT face="Times New Roman">industrial denW de las (05) <B>milias </B>de la línea de costa, </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">son </SPAN></B><FONT face="Times New Roman">y </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">serán pe </SPAN></B><FONT face="Times New Roman">judiciales para la flora y fauna </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">existente.<o:p></o:p></SPAN></B></FONT></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, la zona de protección fue establecida mediante normas de rango superior, en efecto <st1:PersonName w:st="on" ProductID="la Ley General"><st1:PersonName w:st="on" ProductID="la Ley">la Ley</st1:PersonName> General</st1:PersonName> de Pesca promulgada mediante <B>D m t o </B>Ley </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Nm. </SPAN></B><FONT face="Times New Roman">25977, </FONT><B><I><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">su </SPAN></I></B><FONT face="Times New Roman">Reglamento aprobado mediante Decreto Supremo Nro. 012-2001-PE (artículo 63) establece como </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">zona </SPAN></B><FONT face="Times New Roman">reservada para la actividad de pesca artesanal y de menor </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">escala; </SPAN></B><FONT face="Times New Roman">en esa medida, la zona adyacente a la costa comprendida entre las (00) y (55) Millas </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Marinas </SPAN></B><B><SPAN style="FONT-FAMILY: Arial">está </SPAN></B><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">reservada para </SPAN></B><FONT face="Times New Roman">el desarrollo de la actividad</FONT></FONT></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">pesquera <B>artesanal </B>y de menor </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">escala. </SPAN></B><FONT face="Times New Roman">conforme </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">ya </SPAN></B><FONT face="Times New Roman">b disponía el </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Decreto </SPAN></B><FONT face="Times New Roman">Supremo Nro. 017- 92- PE. Por lo tanto en </FONT><B><SPAN style="FONT-FAMILY: Arial">esta </SPAN></B><SPAN style="FONT-FAMILY: Arial">área, </SPAN><FONT face="Times New Roman">está prohibido el uso de artes y aparejos de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">pesca </SPAN></B><FONT face="Times New Roman">que modiñquen </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">las </SPAN></B><FONT face="Times New Roman">condiciones bioecológicas del medio marino, </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">tales </SPAN></B><FONT face="Times New Roman">como redes de arrastre de fondo, redes de cerco industriaies, </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">rastras </SPAN></B><FONT face="Times New Roman">y </FONT><I><SPAN style="FONT-FAMILY: Arial">chinchorms </SPAN></I><FONT face="Times New Roman">mecanizados.</FONT></FONT></FONT></P>

<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, como se tiene señalado, este di~poSitiV0 legal ratifica el mandato imperativo del Decreto Supremo Nro. 017-92-PE del 22 de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">septiembre </SPAN></B><FONT face="Times New Roman">de 1992 por el que </FONT><B><SPAN style="FONT-FAMILY: Arial">se </SPAN></B><FONT face="Times New Roman">declara la </FONT><B><I><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">wna </SPAN></I></B><FONT face="Times New Roman">adyacente a la costa entre las (00) y (05) </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Millas </SPAN></B><FONT face="Times New Roman">Marinas </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">como <I>m118 </I></SPAN></B><FONT face="Times New Roman">de protección de la </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">flora </SPAN></B><FONT face="Times New Roman">y fauna existente, prohibiéndose en dicha </FONT><SPAN style="FONT-FAMILY: Arial">zona </SPAN><FONT face="Times New Roman">el desan-oUo de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">las </SPAN></B><FONT face="Times New Roman">actividades de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">pesca para </SPAN></B><FONT face="Times New Roman">consumo humano </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">directo </SPAN></B><FONT face="Times New Roman">e indirecto con redes de </FONT><B><I><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">cerco, </SPAN></I></B><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">así </SPAN></B><FONT face="Times New Roman">como el uso de métodos, artes y aparejos de pesca que modiñquen las condiciones bioecológicas del </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">medio </SPAN></B><FONT face="Times New Roman">marino.</FONT></FONT></FONT></P>

<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, al autorizarse las labores </FONT><I><SPAN style="FONT-FAMILY: Arial">extractivas </SPAN></I><FONT face="Times New Roman">de desde las <st1:metricconverter w:st="on" ProductID="2 millas">2 millas</st1:metricconverter> de la </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">línea </SPAN></B><FONT face="Times New Roman">de la costa por el Decreto Supremo Nro. 003-2008-PRODUCE </FONT><B><SPAN style="FONT-FAMILY: Arial">asi </SPAN></B><FONT face="Times New Roman">como </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">su </SPAN></B><FONT face="Times New Roman">Reglamento <st1:PersonName w:st="on" ProductID="la Resolución Ministerial">la Resolución Ministerial</st1:PersonName> Nro. 348-2008-PRODUCE, </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">las </SPAN><FONT face="Times New Roman">embarcaciones </FONT></B><FONT face="Times New Roman">industriales </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">in- </SPAN></B><FONT face="Times New Roman">en </FONT><B><SPAN style="FONT-FAMILY: Arial">esta </SPAN></B><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">zona </SPAN></B><FONT face="Times New Roman">y utilizaran redes de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">cerco para la pesca </SPAN></B><FONT face="Times New Roman">de </FONT><SPAN style="FONT-FAMILY: Arial">anchoveta </SPAN><FONT face="Times New Roman">y de </FONT><I><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">especies </SPAN></I><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">pelágicas </SPAN></B><FONT face="Times New Roman">no son selectivas, esto en la medida que las mallas tienen utta abertura ,de malla de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">media pulgada </SPAN></B><FONT face="Times New Roman">(<st1:metricconverter w:st="on" ProductID="13 mm">13 <B>mm</B></st1:metricconverter><B>). </B>y por lo </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">tanto </SPAN></B><FONT face="Times New Roman">aprehenden especies </FONT><SPAN style="FONT-FAMILY: Arial">sin <B>d' </B></SPAN><FONT face="Times New Roman">t . 0 </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">período </SPAN></B><FONT face="Times New Roman">reproductivo. </FONT></FONT></FONT></P>

<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; TEXT-ALIGN: justify; mso-layout-grid-align: none"><FONT size=3><FONT color=#000000><FONT face="Times New Roman">Que, los Pescadores Artesanales de </FONT><st1:PersonName w:st="on" ProductID="la Re"><FONT face="Times New Roman">la </FONT><SPAN style="FONT-FAMILY: Arial">Re</SPAN></st1:PersonName><SPAN style="FONT-FAMILY: Arial">@ón </SPAN><FONT face="Times New Roman"><B>Amquípa </B>han denunciado que actualmente las embarcaciones industriales </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">realizan </SPAN></B><B><SPAN style="FONT-FAMILY: Arial">advidadcs </SPAN></B><FONT face="Times New Roman">de <B>pesca, </B>inciusivc, en zonas comprendidas dentro de los 200 y <st1:metricconverter w:st="on" ProductID="250 metros">250 metros</st1:metricconverter> de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">la </SPAN></B><FONT face="Times New Roman">línea de </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">d. </SPAN></B><SPAN style="FONT-FAMILY: Arial">Asimismo, </SPAN><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">han </SPAN></B><FONT face="Times New Roman">denunciado que por la modalidad y aparejos que <B>ut&an, </B></FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">se: vienen </SPAN></B><B><SPAN style="FONT-FAMILY: Arial">captumudo </SPAN></B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">todo </SPAN><FONT face="Times New Roman">tipo y tamaño de especies, generándose inclusos ruidos, </FONT><B><I><SPAN style="FONT-FAMILY: Arial">smguza, </SPAN></I><FONT face="Times New Roman">materia' </FONT></B><FONT face="Times New Roman">orgánica. derrame de </FONT><SPAN style="FONT-FAMILY: Arial">- </SPAN><FONT face="Times New Roman">carburantes v ¡ubricantes, así como también, </FONT><SPAN style="FONT-FAMILY: Arial">& <B><I>&es </I></B></SPAN><FONT face="Times New Roman">muertos en proceso de descomposición. mso-bidi-font-family: Courier">artesanal </SPAN></B><FONT face="Times New Roman">pesquero, prevista en el </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">Decreto </SPAN></B><FONT face="Times New Roman">Supremo autoritativo, solo </FONT><B><SPAN style="FONT-FAMILY: Courier; mso-bidi-font-family: Courier">es </SPAN></B><FONT face="Times New Roman">un paliativo temporal que no soluciona el estado de postergación y de pobreza por la que atraviesa la pesquería artesanal, y, por el </FONT><B><SPAN style="FONT-FAMILY: Courier;
