reiteradas oportunidades, la Asociación Peruana de Agentes Maritimos (APAM) se
ha pronunciado en contra de los cambios introducidos en el Decreto Legislativo
No 1022 por promover el MONOPOLIO de los servicios portuarios y desterrar la
verdadera inversión en nueva infraestructura portuaria necesaria para la
modernización y desarrollo del Perú.<b><o:p></o:p></b></span></p>
<p class=MsoNormal style='text-align:justify'><b><span style='font-family:"Arial Narrow","sans-serif";
color:blue'><o:p> </o:p></span></b></p>
<p class=MsoNormal style='text-align:justify'><span style='font-size:12.0pt;
font-family:"Arial Narrow","sans-serif";color:black'>La APAM apoya y promueve
la real y efectiva inversión en infraestructura portuaria. En dicha línea de
acción y evaluado el contenido del CONTRATO FINAL DE CONCESION DEL TERMINAL
PORTUARIO DE PAITA creemos que los siguientes puntos deberían ser revisados:<o:p></o:p></span></p>

INFRAESTRUCTURA.-</span></b><span style='font-size:12.0pt;font-family:"Arial Narrow","sans-serif";
color:black'> La Autoridad Portuaria Nacional ha calificando al Terminal
Portuario de Paita como Infraestructura Nueva, olvidando que este terminal fue
construido en los años 60. La definición de Infraestructura NUEVA<b> </b>le<b> </b>otorga
el MONOPOLIO de todas las actividades y servicios portuarios a la actual
infraestructura existente, desnaturalizando todo el proceso de concesión.<o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-family:"Arial Narrow","sans-serif";
color:blue'><o:p> </o:p></span></p>
<p class=MsoNormal style='text-align:justify'><b><span style='font-size:12.0pt;
font-family:"Arial Narrow","sans-serif";color:black'>AUMENTO DE COSTOS AL
COMERCIO PERUANO.- </span></b><span style='font-size:12.0pt;font-family:"Arial Narrow","sans-serif";
color:black'>Las tarifas indicadas en el contrato se incrementarían
aproximadamente en 700% en promedio para el caso de los contenedores vacios,
tarifas que regirán de manera inmediata a la firma del contrato y entrega de
posesión de los bienes al concesionario, pese a que se seguirá utilizando la
infraestructura existente sin cambios significativos. Tomando en cuenta que el
Puerto de Paita es básicamente exportador, el peso del incremento en las nuevas
tarifas por contenedores vacíos en la descarga serán distribuidas a las cargas
de exportación afectando las actividades de comercio exterior.<o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-family:"Arial Narrow","sans-serif";
color:blue'><o:p> </o:p></span></p>
<p class=MsoNormal style='text-align:justify'><b><span style='font-size:12.0pt;
font-family:"Arial Narrow","sans-serif";color:black'>INVERSION CONDICIONADA AL
MOVIMIENTO DE CARGA.- </span></b><span style='font-size:12.0pt;font-family:
"Arial Narrow","sans-serif";color:black'>En el contrato las etapas de inversión
en infraestructura establecen condicionantes que alargarían el desembolso de
inversión fresca, prueba de ello es el establecer como parámetros alcanzar un
movimiento de carga de 180,000 y 300,000 TEUS, máxime si en el 2008 dicho
puerto alcanzo un trafico de 139,000 TEUS, con tendencia actual decreciente
debido al impacto de la crisis económica mundial, a mayo del 2009 solo ha
movilizado 47,000 TEUS.<o:p></o:p></span></p>
<p class=MsoNormal style='text-align:justify'><span style='font-family:"Arial Narrow","sans-serif";

ASUMIDOS POR EL ESTADO.- </span></b><span style='font-size:12.0pt;font-family:
"Arial Narrow","sans-serif";color:black'>Ejecución de los niveles de inversión
comprometida condicionada a volúmenes de carga excesivamente elevadas, con una
participación empresarial sujeta a un Ingreso Mínimo Anual Garantizado (IMAG)
que de no ser alcanzados por el concesionario, serán asumidos por el
Presupuesto General de la República. <o:p></o:p></span></p>

antes expuestas solicitamos a las Altas Autoridades Gubernamentales se revise
el contenido de las Cláusulas que no coadyuvan al real desarrollo del Puerto de
Paita, permiten el MONOPOLIO de los Servicios Portuarios y no aseguran niveles
reales de inversión en nueva infraestructura trasladando al Estado los riesgos
empresariales derivados de su gestión<o:p></o:p></span></b></p>
