económicamente, es decir los Armadores harineros por obvias razones y otro que cual
kamikaze se enfrenta a todos los pescadores artesanales (los verdaderos y de
los otros), se lleva de encuentro el principio precautorio ambiental, niega el valioso
conocimiento empírico de nuestros curtidos y sacrificados pescadores, así como
al más elemental sentido común, ¿cuál será en verdad su motivación, lo sabremos?,
veremos.</span></div>

en el tercer párrafo del numeral 3º <span style=""> </span>del
escrito comentado, que dice:</span></div>

estricto cumplimiento de las normas vigentes sobre pesca artesanal y su
exclusividad dentro de las cinco millas marinas. Dictar las medidas correctivas
y sancionar de acuerdo con los dispositivos</span>”.</span></i></div>

la ley, sin embargo debo poner en conocimiento de todos los interesados, que
durante la administración del viceministro Miranda, PRODUCE decidió que esta
función no debería descentralizarse e incluso así lo pidieron por escrito, para
que se gestione que dicha competencia sea retirada de la ley 27867.</span></div>
<div class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span style="font-family: "Arial","sans-serif"; color: black;"><span style=""> </span></span></div>
<div class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 35.4pt; line-height: normal;"><span style="font-family: "Arial","sans-serif"; color: black;">Por otro lado, dice también este párrafo 3º:</span></div>
<div class="MsoNormal" style="margin: 0cm 0cm 0.0001pt 35.4pt; text-align: justify;"><i style=""><span style="font-size: 9pt; line-height: 115%;"> </span></i></div>
<div class="MsoNormal" style="margin: 0cm 0cm 0.0001pt 35.4pt; text-align: justify;"><i style=""><span style="font-size: 9pt; line-height: 115%;">El 10 de Abril 2004 el Consejo Regional del
Gobierno Regional de Tacna emite la <b>Ordenanza
Regional Nº 007- 2004-CR/GOB. REG.TACNA, </b>que<b> </b>en su Art 1º establece
“<b><span style="">Ratificar que en el litoral de la
Región Tacna, solo se permitirá la extracción de recursos hidrobiológicos
dentro de las 5 millas marinas por los pescadores artesanales (…)</span></b>”,
vigente en todo momento. El Ministerio de la Producción (PRODUCE) interpone
demanda de inconstitucionalidad contra los articulados de la Ordenanza Regional
indicada.</span></i><i style=""><span style="font-size: 9pt; line-height: 115%;"> </span></i><i style=""><span style="font-size: 9pt; line-height: 115%;"><span>Con la Sentencia del Tribunal
Constitucional Nº 0011-2008-PI/TC de fecha 16 de Junio 2010, se declara
infundada la Demanda de Inconstitucionalidad contra esta ordenanza. En
consecuencia la Ordenanza Regional cobra vigencia. <b>Conclusión</b>: Esta Ley
da facultad a los Gobiernos Regionales (sic).</span></span></i></div>
<div class="MsoNormal" style="margin: 0cm 0cm 0.0001pt 35.4pt; text-align: justify;"><i style=""><span style="font-size: 9pt; line-height: 115%;"> </span></i></div>
<div class="MsoNormal" style="margin-left: 35.4pt; text-align: justify;"><span style="font-family: "Arial","sans-serif"; color: black;">Permítaseme
respetuosamente precisar que una Ordenanza Regional tiene “rango de ley” pero
no es una ley, tampoco da ninguna facultad a los Gobiernos Regionales (facultad:
</span><span class="eacep"><span style="font-family: "Arial","sans-serif";">poder,
derecho para hacer algo), dado que la Ordenanza en cuestión “ratifica” </span></span><span style="font-family: "Arial","sans-serif";">lo decretado por el Gobierno Nacional
respecto a la exclusividad dentro de las cinco millas marinas de la pesca
artesanal (art. 52º, inciso “j” de la ley orgánica de los gobiernos regionales),
no transgrede ni excede sus competencias dado que dicha ratificación no
condiciona ni su vigencia, ni su validez, ni su eficacia, ya que es meramente
declarativa. <b style=""><span style="color: black;">(Esto

pierde tiempo nuestro Tribunal Constitucional habiendo tantas demandas por
resolver y como resuelve de manera tan deplorable, la Ordenanza carece del “ius
imperium”, es algo así como si mañana cualquier Gobierno Regional da una
Ordenanza y dice que ellos van a nombrar a los Inspectores del SANIPES, ¿va por
ello PRODUCE a interponer una demanda de inconstitucionalidad?, NO DEBERÍA, es
innecesario, no tiene el gobierno regional competencia para ello. Y cuando
deploro el papel del Tribunal Constitucional, es por lo siguiente:</span></div><div class="MsoNormal" style="margin-left: 35.4pt; text-align: justify;"><span style="font-family: "Arial","sans-serif"; color: black;"><br></span></div>

Ordenanza cuestionada fue emitida en el marco de las
facultades otorgadas por la
Constitución o la
Ley Orgánica de Gobiernos Regionales, o si, por el contrario,
el Gobierno Regional demandado se excedió en el ejercicio de ellas,
menoscabando atribuciones propias del Poder Ejecutivo.</span></i></div><div class="MsoNormal" style="margin-left: 70.8pt; text-align: justify;"><br><i style=""><span style="font-size: 9pt; line-height: 115%;"></span></i><i style=""><span style="font-size: 9pt; line-height: 115%; font-family: "Arial","sans-serif"; color: black;"></span></i></div>

sesudo análisis y fundamentación, le da la razón al gobierno regional de Tacna
y declara INFUNDADA la demanda del PRODUCE, pero como ustedes podrán haberse
dado cuenta por lo que anoté líneas anteriores, esta función o competencia no
ha sido transferida a ningún gobierno regional, entonces ¿se excedió o no
Tacna?, el TC no se pregunta si a la fecha de la dación de la Ordenanza ya se
le había transferido o no esa función, ¿entonces en base a que resolvió?, la
demanda fue mal planteada por PRODUCE y <span style=""> </span>mal
resuelta por el TC, tal como ocurrió con la demanda que sobre los LMCE
interpuso el Colegio de Ingenieros del Perú, en la que nuestro prestigiado TC
equipara Decreto Legislativo con Ley Orgánica y gracias a ello declaró también
INFUNDADA esa demanda, esto fue realmente vergonzoso, y ¿que hizo nuestro
también prestigioso Colegio de Ingenieros del Perú?, nada, así estamos pues.</span></div><div class="MsoNormal" style="margin-left: 35.4pt; text-align: justify;"><span style="font-family: "Arial","sans-serif"; color: black;"><br></span></div>

experiencia, técnicos, pescadores, empresarios, miembros del CIP nacional,
profesionales que conocen realidades distintas del sector por haber viajado o
estudiado en países desarrollados, otros que han viajado por todo el país y
conocen la realidad del sector pesquero, etc. Que como es obvio merecen todo mi
respeto. El suscrito se enmarca en la corriente que concuerda con los
principios de la Ecología; fui docente Cat. Principal, trabaje en el sector
durante 25 años, mis familiares fueron (y son) pescadores artesanales (San
Andres). A los 11 años de edad me inicie en la actividad en “Laguna Grande” con
pescadores de Comatrana (Ica). Siempre con sencillez y humildad, orgulloso de
mis ancestros y cuna.</span></font></div><font face="Times New Roman" size="3">

pretendiendo algunos imponer sus ideas, basados en sus experiencias, y otros,
han estudiado en países desarrollados en el sector pesquero pero con realidades
distintas a la nuestra. Recordemos que han venido misiones de EE.UU, Italia,
Rusia, Polonia, Noruega, etc. para propiciar el desarrollo del sector (El Artesanal
y del Consumo Humano Directo). Pero se le dio mayor impulso a la Pesca de
Consumo Indirecto (La tendencia no ha cambiado: de cada 100 kg de pescado, 90
kg para la producción de harina y aceite, 4,5 kg para la producción de
conservas y congelado y 5,5 kg para el consumo fresco refrigerado). </span><span style="font-family: "sans-serif";">En el año <b style="">1953</b>,
el Dr. Murphy, Blg° estadounidense, de la Compañía Administradora del Guano, en
uno de sus informes dice: "<i style="">El
porvenir de la producción del guano en el Perú y también el de la pesquería
mayor para la alimentación humana, ya sea en forma de productos al natural o
enlatados, depende del tino con que se maneje en la actualidad el porvenir de
la anchoveta. Si ahora se dictan las medidas necesarias para la supervivencia
de esta especie, podrán los peruanos dar por seguro que sostendrán ad perpetum
sus <b style="">riquezas ictiológicas</b>
fundamentales, en caso contrario, tendremos que lamentar que una nueva
‘saturnalia’ se cierna sobre una bioma de tanta importancia (…), y que sirve de
ejemplo de lo que el hombre puede obtener cuando hace uso inteligente de los
recursos que la naturaleza ha puesto en sus manos</i>"…</span></font></div><font face="Times New Roman" size="3">

A PARTIR DE LAS 3 MILLAS MARINAS (</b></span><b style=""><span style="font-family: "sans-serif";">R.M 078-2001-PE<span style="">)</span></span></b><span style="font-family: "sans-serif";"> del </span><span style="font-family: "sans-serif";">10 de marzo 2001<span style="">, indica:</span>
<i style="">Las capturas de los recursos destinados
al consumo humano directo, estas se realizaron mayormente dentro de las 3
millas de la costa. El pejerrey y la cabinza se localizaron frente a Sama, La
Yarada y Vila Vila, entre las 0,7 y 1,5 milllas de la costa, mientras que las
especies como corvina, lorna, pámpano, liza se ubicaron frente a Vila Vila,
entre las 0,6 y 2,5 mn. </i><b style="">Conclusión</b>:
Las especies pejerrey, cabinza, corvina, lorna, pámpano, liza, camotillo, etc.
su pesquería se concentra </span><span style="font-family: "sans-serif";">dentro de las 0.5 y 3,0 millas.</span></font></div><font face="Times New Roman" size="3">

zonas costeras aportan con el 49 % de la producción pesquera mundial y que la
franja costera entre las 0 y 5 millas marinas es un área de protección de la
biodiversidad, zona donde las especies realizan sus actividades biológicas y
fisiológicas.</span><span style="font-family: "sans-serif";"> Los
pescadores artesanales (actividad ancestral) que siente que con s 5 millas de protección,
se logra sostenibilidad en el tiempo para los recursos que se reproducen en esta
zona y que no pueden ser sometidos a una sobrepesca.<span style="color: black;"> <b style="">Conclusión</b>:</span></span><span style="font-family: "sans-serif";"> se deben resguardar
las zonas de reproducción y desarrollo de las especies ícticas, protegiendo la
flora y fauna marinas, y fomentando la pesca artesanal con un enfoque ecosistémico.</span></font></div><font face="Times New Roman" size="3">

establece las Funciones en Materia Pesquera; en el inciso (J) <span style=""> </span>faculta al G.R: “<i style="">Vigilar el estricto cumplimiento de las normas vigentes sobre pesca
artesanal y su exclusividad dentro de las cinco millas marinas. Dictar las
medidas correctivas y sancionar de acuerdo con los dispositivos</i>”. </span><span style="font-family: "sans-serif";">El 10 de Abril 2004 el Consejo Regional del Gobierno Regional de Tacna
emite la <b>Ordenanza Regional Nº 007- 2004-CR/GOB. REG.TACNA, </b>que<b> </b>en
su Art 1º establece “<b><i>Ratificar que en el litoral de la Región Tacna, solo
se permitirá la extracción de recursos hidrobiológicos dentro de las 5 millas
marinas por los pescadores artesanales (…)</i></b>”, vigente en todo momento. El
Ministerio de la Producción (PRODUCE) interpone demanda de inconstitucionalidad
contra los articulados de la Ordenanza Regional indicada.</span><font face="Calibri"> </font><span style="font-family: "sans-serif";">Con la Sentencia del Tribunal Constitucional Nº 0011-2008-PI/TC de<span style=""> </span>fecha 16 de Junio 2010, se declara infundada
la Demanda de Inconstitucionalidad contra esta ordenanza. En consecuencia la Ordenanza
Regional cobra vigencia. <b>Conclusión</b>: Esta Ley da facultad a los
Gobiernos Regionales.</span><span style="color: black; font-family: "sans-serif";"></span></font></div><font face="Times New Roman" size="3">

el 2008 para hacer permanente el <b style="">Régimen
Especial de Pesca-REP</b>, la “Federación de Pescadores Artesanales de Tacna” (FEPARTACNA),
Empresarios harineros (ex viceministro del sector), el Director del Sector en
Tacna y sus “lideres” especialistas en Lobbys, prepararon el camino, propiciando
la formación de treinta (30) <b style="">Organizaciones
Sociales Pescadores Artesanales (OSPAS)</b> para consolidar semejante atropello
contra la biodiversidad marina costera con el nefasto <b style="">D.S N° 003-2008- PRODUCE</b>, que autorizaba a<span style="color: black;">
las embarcaciones industriales pescar dentro de 1.0 y 1.5 millas en el litoral de
Tacna (inclusive en la zona de las rompientes). </span>Con trámites rápidos y
la compra sucia de conciencias (víveres, un saco de arroz, una moto, una
computadora, una casa de madera, etc.) consiguieron la firma de falsos
pescadores, y coludidos con el Gobierno Regional del Eco. Ordoñez traicionaron
a los <b style="">pescadores artesanales</b> y
quitaron el alimento al pueblo y a los niños desnutridos crónicos para dárselos
a los animales de los países desarrollados, <b style="">formalizando</b> con una simple ACTA su participación <span style=""> </span>en el “REP”, sin el acuerdo de su Consejo
Regional.<span style=""> </span></font></span></div><font face="Times New Roman" size="3">

proyectos que beneficien a las familias y a los miembros de las OSPAs ubicadas
en la zona sur del país. El <b><span class="yui_3_2_0_15_1328383833886365" style="font-family: "sans-serif"; font-weight: normal;">Art 4º indica:</span></b>
los Programas de Promoción y Desarrollo de la actividad Pesquera Artesanal que
se ejecuten e implementen, con los aportes <span style=""> </span>de APROSUR, serán aprobados por una <b style="">Comisión Técnica</b> <b style="">encargada de supervisar el uso y destino de los aportes. </b>Los
aportes de APROSUR durante los años 2008, 2009, 2010 y 2011 alcanzó la suma de </span>11
millones de nuevos soles generados por el <b style="">REP</b>,
que debió destinarse a todos los pescadores artesanales de la <b style="">Región Tacna</b> en Proyectos Sostenibles, ¿<b style=""><i style="">En
que se han invertido</i></b>?, ¿<b style=""><i style="">Qué proyecto sostenible se ha ejecutado para
lo pescadores artesanales</i></b>?, ¿<b style=""><i style="">A quienes ha beneficiado las casas de
madera, las motos, los aparejos de pesca, las computadoras, los víveres</i></b>,
<b style="">etc.</b>?. ¿<b style="">Quiénes se han enriquecido con PROSUR</b>?</font></span></div><font face="Times New Roman" size="3">

con 67 % proteínas) debe utilizarse <span style=""> </span>6.7
kg de pescado fresco (anchoveta y otras especies de C.H.D), el precio de la
harina <b>US$ 1,500.00 por TM (S/ 4,200.00 </b><b style="">nuevos soles). Paradójicamente,<span style="">
</span></b><span style="">los peruanos, singularmente
los pobladores de la Región Tacna, para adquirir un kilogramo de proteínas (vía
pescado fresco) tiene que pagar: si es cojinovita S/ 141.00 nuevos soles, si es
