Pesqueras y Acuícolas aprobada por Decreto Supremo N° 040-2001-PE determina
parámetros generales que se requieren para el diseño, construcción y
equipamiento de embarcaciones pesqueras y determina en su Artículo 4° que son
responsables directos del cumplimiento de las disposiciones contenidas en la
presente norma sanitaria, las personas naturales o jurídicas sean estos, pescadores,
patrones o capitanes de pesca, manipuladores de pescado, transportistas,
operadores de establecimientos industriales o artesanales de procesamiento,
desembarcaderos o puertos pesqueros, mercados mayoristas, operarios, vendedores
mayoristas o minoristas o cualquier otra que de una u otra manera efectué

comprometidos en el desarrollo y cumplimiento de lo dispuesto en la norma
indicada; siendo el ente contralor, supervisor y fiscalizador SANIPES

para el Enfriamiento de la pesca y Buenas Practicas de Estiba y Preservación
para el cumplimiento de la Inocuidad y Trazabilidad propuesto por SANIPËS mediante
Resolución Directoral N° 021-2016-SANIPES-DSNPA del 03-11-2016, las
embarcaciones pesqueras artesanales deben estar <b id="yui_3_16_0_ym19_1_1479125670404_14458">FORMALIZADAS</b>, contar con el Permiso de Pesca y Habilitación Sanitaria,
lo que en la práctica no se cumple porque el 80 % aproximadamente de la flota artesanal

las Buenas Practicas de estiba y preservación para el Cumplimiento de la
Inocuidad y Trazabilidad es la Inoperatividad y obsolescencia de la flota
artesanal que es la que alimenta a la industria para el consumo humano directo

entendimiento de la Trazabilidad no solo implica hablar de la bodega si es
refrigerada o insulada sino aplicar los términos y condiciones establecidas por
la OMI. SOLAS, FAO, en el de Perú además aplicar la Norma Sanitaria y el
Reglamento General Capitanías etc. <o:p id="yui_3_16_0_ym19_1_1479125670404_14469"></o:p></span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14470"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14471"> </span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14472"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14473">Por
tal motivo todo barco incluyendo los artesanales cuya pesca se destine al
consumo local o exportación debe llevar a bordo una serie de documentos de
obligado cumplimiento a lo largo de toda la cadena de producción del pescado;
desde su extracción hasta su venta; por eso, es importante llevar a bordo una
bitácora de pesca en el que se anote sus operaciones, indicando las cantidades
capturadas y transportadas a bordo superiores a 500 kilogramos.<o:p id="yui_3_16_0_ym19_1_1479125670404_14474"></o:p></span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14475"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14476"> </span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14477"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14478">Los
armadores deben respetar la aplicación del control efectuado por los operadores
a fin de garantizar la trazabilidad en toda la cadena de la producción y
comercialización del pescado, tanto en el mar como en los puertos, durante el
transporte, en las instalaciones de transformación y durante la fase de
comercialización.<o:p id="yui_3_16_0_ym19_1_1479125670404_14479"></o:p></span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14480"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14481"> </span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14482"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14483">Para
implementar la trazabilidad en barcos artesanales de acuerdo a las condiciones
exigidas se debe construir barcos que garanticen las exigencias mínimas de una
entidad clasificadora. Así mismo las normas y dispositivos que se emitan deben
contemplar las recomendaciones efectuados por estos organismos internacionales
sobre la seguridad de la vida humana. Es decir las embarcaciones pesqueras en
general deben contar con buen equipamiento y autonomía que garantice el
transporte de la carga (pesca) hacia puerto.<o:p id="yui_3_16_0_ym19_1_1479125670404_14484"></o:p></span></div><div style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;line-height:normal;mso-layout-grid-align:none;text-autospace:none" id="yui_3_16_0_ym19_1_1479125670404_14485"><span style="font-size:12.0pt;mso-bidi-font-family:Calibri;mso-bidi-theme-font:minor-latin" id="yui_3_16_0_ym19_1_1479125670404_14486"> </span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14487"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14488">En los últimos diez (10) años de
intervalo de las dos Encuestas Estructurales (1995-2004), el número de
embarcaciones se incrementó en 54%, de 6,258 a 9,667 unidades. Cinco (5)
años después, en el año 2009, la flota pesquera artesanal se compone
de 10,385 embarcaciones, lo que representa un incremento de 7,4 % (718
embarcaciones más) y según Censo Marzo 2012, la flota se incrementó a 16,045
unidades; mientras que la capacidad de bodega acumulada tuvo un
incremento global de 41,6 % (de 36,929 t a 52,026 t) y la situación se agrava
con la construcción ilegal de embarcaciones artesanales en los astilleros
informales y formales, lo cual pone en riesgo la conservación y sostenibilidad
de los recursos costeros y afecta la diversidad biológica marina.<o:p id="yui_3_16_0_ym19_1_1479125670404_14489"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14490"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14491"> <o:p id="yui_3_16_0_ym19_1_1479125670404_14492"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14493"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14494">Consultando en el Ministerio de la
Producción sobre los resultados reales del CENSO en relación con la capacidad
de bodega de las 16,045 embarcaciones pesqueras artesanales me respondieron que
no lo han trabajado ya que no se verifico las mediciones
de las mismas, solo tomaron los datos indicados en la matricula.<o:p id="yui_3_16_0_ym19_1_1479125670404_14495"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14496"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14497"> <o:p id="yui_3_16_0_ym19_1_1479125670404_14498"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14499"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14500">Es importante destacar que en el año
2010, el mayor número de embarcaciones que conformo la flota artesanal son
unidades menores de 10 t de volumen de bodega (9 272 con una capacidad
acumulada de 30 853 t), los que ejercen una fuerte presión de pesca, principalmente
sobre los recursos hidrobiológicos costeros y bentónicos, por lo que el IMARPE
recomendó como medida precautoria detener paulatinamente la construcción de
embarcaciones menores o iguales a 10 m3, de ser el caso la construcción de
embarcaciones de hasta 10 m3 de bodega para reemplazo, deberán estar orientadas
a la pesca de los recursos de temporada (perico, tiburones, bonito, etc.), así
como a la captura de pota y pelágicos costeros (jure! y caballa).<o:p id="yui_3_16_0_ym19_1_1479125670404_14501"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14502"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14503"> <o:p id="yui_3_16_0_ym19_1_1479125670404_14504"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14505"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14506">Sobre el particular permítanme agregar
que las embarcaciones artesanales comienzan a aumentar sus dimensiones
unilateralmente cuando aparece nuevos retos de pesca mar abierto y
estas requerían contar con mayor autonomía para llevar más petróleo, agua
dulce, hielo, víveres y tripulantes. Aumentaron la Eslora, Manga,
Puntal y la Capacidad de bodega; estos constructores no necesitaron de planos,
la experiencia los llevo a encontrar un prototipo de embarcación que les dio
resultado y comenzó una reconstrucción masiva que el estado ni las Capitanías
de Puerto lograron detener, ante una ley que daba preferencias a la pesca
artesanal.<o:p id="yui_3_16_0_ym19_1_1479125670404_14507"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14508"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14509"> <o:p id="yui_3_16_0_ym19_1_1479125670404_14510"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14511"><span style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14512">Particularmente considero que
estas </span><span lang="ES" style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14513">modificaciones se efectuaron
por seguridad de la nave, ya que las consignadas en las matriculas resultaron
demasiadas pequeñas para mantener su estabilidad en las zonas donde se suele
pescar POTA o Calamar Gigante, la misma que generalmente se
encuentra entre las 10 y 45 millas de la costa, en oportunidades a 60 millas y
últimamente debemos efectuar travesías muy largas por lo que se requiere
mayor autonomía.<o:p id="yui_3_16_0_ym19_1_1479125670404_14514"></o:p></span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14515"><span lang="ES" style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14516"> </span></div><div style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;" id="yui_3_16_0_ym19_1_1479125670404_14517"><span lang="ES" style="font-size: 12pt;" id="yui_3_16_0_ym19_1_1479125670404_14518">En ningún
dispositivo se menciona sobre la estabilidad de la nave, lo que resulta no
técnico ya que los objetivos de pesca tienen un hábitat y desplazamiento y las
embarcaciones deben construirse sobre las condiciones de mar en dichas zonas de

Artesanales más afectadas con este problema es la que pesca los
recursos Perico y Pota por que necesitan tener mayor autonomía; a estas

artesanales, </span><span lang="ES" style="font-size:12.0pt;line-height:115%;mso-bidi-font-family:"Times New Roman";mso-ansi-language:ES;mso-fareast-language:ES" id="yui_3_16_0_ym19_1_1479125670404_14791">debemos mencionar que en los últimos dos años hemos estudiado y diseñado un
nuevo prototipo de embarcación pesquera artesanal de Innovación, que contempla </span><span style="font-size:12.0pt;line-height:115%" id="yui_3_16_0_ym19_1_1479125670404_14792">desde principios generales hasta
factores específicos de gran ayuda para futuras construcciones en la pesca de
la pota y perico. Se logra finalmente la especificación de un proyecto

el Banco industrial otorgo Líneas de Crédito para la construcción y
equipamiento de la flota artesanal existente.
Esta flota posteriormente en un 60% aproximadamente fue reemplazada por
embarcaciones de menor escala pero manteniendo las características de su
Certificado de Matricula original y Permiso de Pesca con menores dimensiones.
